Welcome to Balansh ("Company", "we", "our", "us"). By accessing or using our mobile application (the "App"), website, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

1. Acceptance of Terms
By creating an account, accessing, or using Balansh, you confirm that you are at least 18 years old (or of legal age in your jurisdiction) and capable of entering into a binding contract. If you are using the App on behalf of an entity, you represent that you have the authority to bind that entity.

BALANSH IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. THE CONTENT PROVIDED BY BALANSH, INCLUDING CYCLE PREDICTIONS, SYMPTOM INSIGHTS, AND AI-GENERATED NUTRITIONAL SUGGESTIONS, IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.
- NO DOCTOR-PATIENT RELATIONSHIP: USE OF THE APP DOES NOT CREATE A PROVIDER-PATIENT RELATIONSHIP BETWEEN YOU AND BALANSH.
- NOT FOR DIAGNOSIS: YOU SHOULD NOT RELY ON INFORMATION FROM BALANSH AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.

3. Description of Services
Balansh provides a "Biological GPS" for women's health, offering:
- Cycle Tracking: Mathematical estimation of cycle phases (Menstrual, Follicular, Ovulatory, Luteal).
- Nourish+ AI: An AI-powered conversational interface ("Cravings Decoder") that provides nutritional education based on user inputs.
Limitations: We do not guarantee that cycle predictions will be 100% accurate, as individual biology varies.
4. Artificial Intelligence (AI) Disclosure
Our "Nourish+" features utilize Large Language Models (LLMs) provided by third parties (e.g., OpenAI). By using these features, you acknowledge:
- Potential for Error: AI systems may occasionally produce incorrect, inaccurate, or "hallucinated" information. You are responsible for verifying any advice before acting on it.
- No Human Oversight: Responses are generated automatically and are not reviewed by a human nutritionist or doctor in real-time.
5. Subscriptions & Payments ("Nourish+")
Certain features of Balansh (e.g., unlimited AI chat) are available only through a paid subscription ("Nourish+").
- Billing: We use Stripe to process payments. By subscribing, you authorize us to charge your payment method the subscription fee (e.g., $5.99/mo) plus applicable taxes.
- Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date.
- Cancellation: You may cancel your subscription at any time via your App settings or Apple/Google Subscription manager. You will continue to have access until the end of your current billing period.
- No Refunds: Payments are non-refundable, and there are no refunds or credits for partially used periods, except as required by applicable law.
6. User Conduct
You agree not to use the App for any illegal purpose, not to harass others, not to reverse engineer the source code, and not to use the App to distribute medical misinformation.
7. Intellectual Property
The Balansh App, including its "Cycle Syncing" logic, logos, design, text, graphics, and code, is the property of Balansh and is protected by United States and international copyright, trademark, and intellectual property laws.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: BALANSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL BALANSH’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00) OR THE AMOUNTS PAID BY YOU TO BALANSH FOR THE PAST 12 MONTHS OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless Balansh, its founders, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
10. Dispute Resolution (Arbitration)
PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in New York, NY, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the App or email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
